We take your privacy very seriously. Please read this privacy notice carefully as it contains important information on how and why we collect, store, use and share your personal data. It also explains your rights in relation to your personal data and how to contact us or supervisory authorities in the event you have a complaint.

We collect, use and are responsible for certain personal data about you. When we do so we are subject to the UK General Data Protection Regulation (UK GDPR) and other UK privacy legislation. We may also be subject to the EU General Data Protection Regulation (EU GDPR) in relation to services we offer to individuals and our wider operations in the European Economic Area (EEA), and to the data privacy laws local to the other countries we operate in (such as the US).

Personal data we collect about you

The personal data we collect about you depends on the particular services we provide to you. We may collect and use the following personal data about you:

  • your name and contact information, including email address and telephone number and company details;
  • information to check and verify your identity, eg your date of birth;
  • your gender, if you choose to give this to us;
  • location data;
  • your billing information;
  • transaction and payment card information;
  • your personal and professional interests;
  • your professional online presence, eg LinkedIn profile;
  • your contact history, purchase history and saved items;
  • information to enable us to undertake credit or other financial checks on you;
  • information about how you use our platform, network, communication and other systems.

We collect and use this personal data for the purposes described in the section ‘How we use your personal data and why’ below. If you do not provide personal data we ask for, it may delay or prevent us from providing services to you.

Children

Our services and website are not directed towards nor intended for the use of children, and we do not knowingly collect personal data of anyone under the age of 13. If you have reason to believe that a child under 13 has provided personal data to Stelia, please email us at [email protected]. We will investigate any notification and, if appropriate, delete the personal data from our systems. Anyone under 18 accessing our services must have permission from their parent or guardian.

How your personal data is collected

We collect most of this personal data directly from you: in person, by telephone, text or email and/or via our website and the Stelia platform. However, we may also collect information:

  • from publicly accessible sources, eg Companies House or HM Land Registry;
  • directly from a third party with your consent, eg sanctions screening providers, credit reference agencies, and customer due diligence providers;
  • from cookies on our website and/or platform (for more information on our use of cookies, please see our Cookies notice below);
  • via our IT systems, eg through automated monitoring of our platform and other technical systems, such as our computer networks and connections, CCTV and access control systems, communications systems, email and instant messaging systems.

How we use your personal data and why

Under data protection law, we can only use your personal data if we have a proper reason, eg:

  • where you have given consent;
  • to comply with our legal and regulatory obligations;
  • for the performance of a contract with you or to take steps at your request before entering into a contract; or
  • for our legitimate interests or those of a third party.

A legitimate interest is when we have a business or commercial reason to use your personal data, so long as this is not overridden by your own rights and interests. Special category personal data

We do not currently process special category personal data. However, should we process special category personal data, we will also ensure we are permitted to do so under data protection laws, eg:

  • the processing is necessary to protect your (or someone else’s) vital interests where you are physically or legally incapable of giving consent; or
  • the processing is necessary to establish, exercise or defend legal claims.

Sharing with third parties

We routinely share personal data with:

  • companies within the Stelia Ltd group;
  • third parties we use to help deliver our services to you, eg payment service providers and MailChimp;
  • third parties approved by you, eg social media sites you choose to link your account to, or third-party payment providers;
  • credit reference agencies;
  • our bank.

We only allow those organisations to handle your personal data if we are satisfied they take appropriate measures to protect it. We also impose contractual obligations on them to ensure they can only use your personal data to provide services to us and to you. We or the third parties mentioned above occasionally also share personal data with our external auditors, our and their professional advisers (such as lawyers), law enforcement agencies, courts, tribunals and regulatory bodies, and other parties that have or may acquire control or ownership of our business in connection with a significant corporate transaction or restructuring. Usually information will be anonymised, but this may not always be possible. The recipient of any of your personal data will be bound by confidentiality obligations. We will not share your personal data with any other third party without your consent.

Marketing

We will use your personal data to send you updates (usually by email or text message) about our services, including exclusive offers, promotions or new services. We have a legitimate interest in using your personal data for marketing purposes, which means we do not usually need your consent to send you marketing information. If we change our marketing approach in the future so that consent is needed, we will ask for this separately and clearly.

You have the right to opt out of receiving marketing communications at any time by using the ‘unsubscribe’ link in emails or the ‘STOP’ number in texts, or by updating your marketing preferences on the Stelia platform. We will always treat your personal data with the utmost respect, and will never sell it to other organisations for marketing purposes without your consent.

Where your personal data is held

Personal data may be held at our offices and those of our group companies, third-party agencies, service providers, representatives and agents as described above. Some of these third parties may be based outside the UK/EEA. For more information, including how we safeguard your personal data when this happens, see ‘Transferring your personal data out of the UK and EEA’ below.

Retention

We will not keep your personal data for longer than we need it for the purpose for which it is used, unless we are required to retain it by applicable law (eg as part of our business records obligations). If you no longer have an account with us, or we are no longer providing services to you, we will usually delete or anonymise your account data after 2 years.

Transferring your personal data out of the UK and EEA

It is sometimes necessary for us to transfer your personal data to countries outside the UK and EEA. In those cases we will comply with applicable UK and EEA laws designed to ensure the privacy of your personal data. We may transfer your personal data to our employees, subcontractors and/or service providers located outside the UK, in the US. We may also transfer your personal data from the EEA to the UK.

Under data protection laws, we can only transfer your personal data to a country outside the UK/EEA where the UK government (or, for EEA transfers, the European Commission) has decided the country ensures an adequate level of protection, where there are appropriate safeguards in place together with enforceable rights and effective legal remedies for you, or where a specific exception applies. Where we transfer your personal data outside the UK or EEA, we do so on the basis of an adequacy regulation or, where this is not available, legally-approved standard data protection clauses recognised or issued under Article 46(2) of the UK GDPR and/or EU GDPR. Keeping your personal data secure

We have appropriate security measures to prevent personal data from being lost accidentally, or used or accessed unlawfully. We limit access to your personal data to those who have a genuine business need to access it. Those processing your personal data will do so only in an authorised manner and are subject to a duty of confidentiality. We continually test our systems and we follow top industry standards for information security. We also have procedures to deal with any suspected data security breach, and we will notify you and any applicable regulator of a suspected breach where we are legally required to do so.

Please contact us if you have any queries or concerns about our use of your personal data, and we hope we will be able to resolve any issues you may have. You may also have the right to lodge a complaint with the Information Commissioner (the UK data protection regulator) and/or the relevant supervisory authority in your jurisdiction. Stelia’s lead supervisory authority is the Information Commissioner’s Office in the UK.
